In the article “Legislative Developments in Patents: Prospects for the PREVAIL and RESTORE Acts and PERA in 2025,” published by IP Watchdog, partner Philip Nelson discusses three significant bills that could affect patent law in the forthcoming year.
Mr. Nelson focuses on the “Promoting and Respecting Economically Vital American Innovation Leadership Act” (PREVAIL Act); the Realizing Engineering, Science, and Technology Opportunities by Restoring Exclusive Patent Rights Act (RESTORE Act); and the “Patent Eligibility Restoration Act” (PERA).
In the article, Nelson provides background on each bill, details their proposed provisions to patent law, and notes the arguments made in support of and against them. While each bill is at a different stage in the legislative process, he notes that they all have bipartisan sponsors and are “intended to benefit patent owners.” He maintains that this bipartisan support gives the PREVAIL and RESTORE Acts and PERA “decent chances of becoming law” and encourages patent holders and practitioners to follow their progress in 2025.
