Netflix recently announced new guidance for using generative AI in content produced for its platform, requiring production partners to disclose any intended use of AI, prohibiting training models on uncleared content, and mandating written approval for certain outputs. Speaking with World Trademark Review (WTR), Knobbe Martens Copyright Litigation Practice Co-Chair Mark Lezama shared his perspective on the implications of these new guidelines.
The guidance, intended for filmmakers, production partners, and vendors, can help mitigate Netflix’s legal and reputational risk, Lezama maintained. But he noted that the efficacy of the new guidelines would ultimately depend on partner compliance.
While Lezama identified difficulties in implementing the guidelines, he highlighted Netflix’s focus on “early disclosure and dialogue, which always helps when managing risk.”
