IRVINE, Calif., October 22, 2025 – A team from Knobbe Martens successfully represented BW Essentials LLC, maker of Troomy Nootropics supplements, in a contested trademark opposition before the U.S. Patent and Trademark Office’s Trademark Trial and Appeal Board (TTAB).
The Knobbe Martens team representing BW Essentials included partners Jonathan Menkes, Jacob Rosenbaum, and Matt Bellinger, as well as associate Eric Blosser.
The case, Troop Nutrition, Inc. v. BW Essentials LLC (Opposition No. 91287431), involved Troop Nutrition’s challenge to BW Essentials’ trademark applications for TROOMY and TROOMY NOOTROPICS, which cover nootropic and functional mushroom-based dietary supplements. Troop Nutrition, the owner of a registration for TROOP in connection with mushroom extract supplements, claimed that consumers would likely confuse the marks and opposed registration of the TROOMY and TROOMY NOOTROPICS marks.
Despite Troop Nutrition’s assertions that the goods and channels of trade overlapped, the TTAB dismissed the opposition in full, finding that confusion was not likely. The Board determined that TROOP and TROOMY differ in appearance, pronunciation, and meaning, and that the overall commercial impressions of the marks are distinct. The Board further found that the TROOP mark was entitled to only a narrow scope of protection, given its conceptual weakness as a reference to a group of mushrooms.
The TTAB also recognized that consumers of dietary supplements exercise a heightened degree of care in making purchasing decisions, and that there was no credible evidence of actual confusion despite several years of concurrent use in the marketplace. The Board rejected the opposer’s claim of bad faith and credited BW Essentials’ testimony that TROOMY was independently developed as a playful reference to “true me” and “shroom,” aligning with the company’s creative and wellness-focused branding.
Commenting on the matter, Mr. Menkes said, “We could not be happier for our client. This was a tremendous team win that highlights our firm’s strength in successfully representing clients in TTAB matters on both sides of the ‘v.’”
This victory clears the way for BW Essentials to register all four of its TROOMY-formative marks on the Principal Register. The decision further reinforces Knobbe Martens’ strong record of success and experience in complex trademark proceedings before the TTAB.
